Full Expungements, or Section 18 Expungements, erase your criminal arrest, criminal charge, criminal court proceedings and other public criminal records. In fact, once the Full Expungement Order is filed and officially processed, the past criminal incident is deemed never to have occurred. After a successful expungement, a person can legally state that the past incident that has been expunged never occurred.
Partial expungements in Oklahoma, sometimes also referred to as “991c expungements", only apply to defendants who have received a deferred sentence. After a successful section 991c Expungement, a person's case record will be removed from both OSCN.net and ODCR.com. Additionally, their OSBI record will state they have been arrested for the offense, but they “plead not guilty and the case was dismissed."
Contact our office to see if you are eligible for an expungement. Oklahoma law permits many different types of cases to be expunged. The statutory categories for people who are eligible for expungement are listed in Title 22 of the Oklahoma Statutes, in section 18(A) and section 991c.
Multiple arrests in the same county can be filed for in one petition, however, a separate petition must be filed for each county where a person has records they want expunged.
There are specific paperwork, notice, and legal requirements necessary in order to successfully petition for an expungement of your arrest records. The Oklahoma State Bureau of Investigation (OSBI) strongly suggests you get a lawyer to advise you of the proper actions to take.
